In short

  • You need to be 18 or over. One account per person, with a Maltese mobile number.
  • The sale is between the buyer and the seller. No money goes through us.
  • Meeting is your own decision and at your own risk.

Maltayard is a place for people in Malta and Gozo to sell things to each other. These are the rules that make that work.

1. Who we are

Maltayard is run by ITECHIN E-TİCARET LİMİTED ŞİRKETİ, a limited company registered in İstanbul, Türkiye (trade register no. 481905-5), at Fenerbahçe Mah. İğrip Sk. No: 13 İç Kapı No: 1, Kadıköy, İstanbul, Türkiye.

For anything about these terms, write to [email protected]. The full company details are at maltayard.com/imprint.

2. Who can use it

You need to be 18 or over. The service is meeting people and agreeing a price, and both of those need an adult.

One account per person, with a Maltese mobile number.

3. What you can list

It has to be yours, legal to sell, and really for sale. One listing per item.

The photos have to be of the actual thing. Not a catalogue picture of one like it.

4. What cannot be listed

Weapons and replicas, fireworks, live animals, medicines, counterfeits, tobacco, and anything needing a licence we cannot check.

The full list is in What you cannot list, and every new listing is checked against it.

5. No phone numbers in a listing

Not in the description and not written into a photo. Numbers in listings are how most scams here start.

Buyers reach you in chat, and that is the point: offers and reviews are only recorded if the conversation happened here.

6. We are not part of the sale

You agree the price and you meet. No money goes through us, and we never see, inspect, hold or deliver the item.

The sale is between the buyer and the seller. What is sold, and whether it is what it looked like, is between the two of you.

We do not guarantee that an item, a description or a person is what it claims to be. A label such as confirmed says only what was checked — a phone number, an email address — and nothing more.

7. Consumer rights

Sales here are between private individuals, so EU consumer rights — a cooling-off period, a trader’s guarantee, free returns — do not apply to them.

The seller still has to describe the item honestly, and the general law on sales still applies. A seller who sells as a business says so on their listings, and EU consumer rights do apply to them.

8. Meeting is your own decision

Meeting is your own decision and at your own risk. We are not there and we cannot check who turns up.

Meet in a busy place, in daylight, and bring someone with you. Check the item before you pay, and never pay before you have seen it — a deposit asked for in advance is the most common scam here.

No money moves through Maltayard, so a message or link asking for card or bank details “for Maltayard” is a scam. If something feels wrong, stop and report it. If you are in danger, call 112.

9. Offers

An offer is an intention, not a contract. It expires after 48 hours.

Accepting one agrees a price. It does not sell the item, and the other offers stay open.

10. Reviews

Only someone who agreed a deal with you in chat can review you. Buyer and seller write independently, and neither is shown until both have written or 12 days pass.

A review says what happened. It is not a place to name or describe a person.

11. How to treat each other

No asking for money before you meet. No abuse, threats or harassment.

No fake accounts. Breaking our rules once badly, or again after a suspension, can close the account.

12. Your responsibilities

You are responsible for what you list and what you write. Describe things honestly, sell only what is yours to sell and legal in Malta, and keep to what you agree in chat.

If you sell as a business, say so on your listings.

13. How we check things

New listings pass an automated check against these rules. Most are never read by a person.

When something is reported, or the automated check is unsure, a person on our team reads it and decides.

14. How listings are ordered

In search you choose the order in Sort by. How each order works is under How results are ranked, on the results screen in the app.

Explore shows the listings nearest you first, then the newest.

Explore is ordered by what you look at only when Personalised Explore is switched on, and this section will say how before that starts.

15. Reporting something

Every listing, chat and profile has a Report action. Tell us what is wrong and a person reads it.

You get an answer, and if we act on it you are told what we did.

16. Illegal content

Content promoting terrorism or other serious crime is removed and reported to the Maltese authorities, and the account is closed.

17. Keeping evidence and working with the authorities

We do not read chats. When you report a chat, you choose the messages to send us, and a person on our team reads only those. A chat is opened only when the law or an authority requires it. Chats are deleted two years after the last message.

We keep a chat longer only when it is needed as evidence: while a report or a decision about it can still be challenged — six months after our decision, or two years after we close an account for good — while the law or an authority requires it, or while a dispute about it is going on. Then we delete it.

Where the law requires it, or where someone’s life or safety is at risk, we share information with the police or other authorities in Malta or the EU.

18. If something comes down

We take a listing down when it breaks these rules. We tell you what happened, which rule, and whether a person or the automated check decided it.

If you think we got it wrong, raise a request in Help and a person reads it.

19. Disagreements between members

If a sale goes wrong, talk to the other person first. We do not decide who is right in a disagreement about a sale, and we do not refund or compensate.

We do act on our rules — we can take a listing down, warn, suspend or close an account, and we tell you what we did and why. You can take a dispute to the police, the Small Claims Tribunal or the courts in Malta; if you do, tell us in Help and we keep the chat.

20. Suspending an account

We can suspend an account that breaks these rules repeatedly, or once badly.

We tell you which rule, who decided, and how to challenge it.

21. Closing your account

You can close it in Settings at any time. Your listings come down with it, and reviews you wrote stay with your name removed.

22. Our liability

We run Maltayard with reasonable care, but we cannot promise it will always be available or free of errors, and we are not responsible for what members list, write or do, or for a sale between members.

As far as the law allows, we are not liable for indirect loss, or for loss arising from a sale, a meeting or any other dealing between members.

Nothing in these terms limits our liability for fraud, wilful misconduct or gross negligence, for death or personal injury caused by our negligence, or for anything else the law does not allow us to limit, and nothing in them affects your rights as a consumer.

23. The law that applies

Maltese law applies to these terms and to anything arising from them, and the courts of Malta can hear any dispute about them. If you live elsewhere in the EU, you keep the protection of the law of the country where you live, and you can bring a claim there.
